HOLLYWOOD, Calif. — Kiefer Sutherland won't be the butt of any more jokes.
The 42-year-old actor is off the hook after he was accused of headbutting fashion designer Jack McCollough at a New York City nightclub in May.
"We declined to prosecute after a full investigation," the Manhattan District Attorney's Office said Tuesday in a statement. "That included speaking to the complaining witness, who was quite uncooperative."
After the decision, the Los Angeles City Attorney's Office also cleared Sutherland of violating his probation, stemming from his 2007 arrest on drunken driving charges.
The "24" star was charged with misdemeanor assault after getting into an altercation with McCollough, founder of the Proenza Schouler fashion house, at an after-party for the Met Costume Institute Gala. The incident reportedly began when McCollough bumped into Brooke Shields, who Sutherland was speaking with at the time. Sutherland then allegedly headbutted the designer when tempers escalated.
Sutherland famously spent 48 days in jail after his 2007 DUI arrest, his second for driving under the influence which in turn resulted in a five-year probation sentence.
