MIAMI — Alex Rodriguez has responded to his wife Cynthia's divorce claim and he's playing hardball.
According to the New York Daily News, the New York Yankees slugger is demanding that the couple's prenuptial agreement be enforced. He also wants the accusations that he cheated to be removed from the court record. The court papers are expected to be filed today.
In his filing, Rodriguez admits the marriage is "irretrievably broken." But the All-Star points out that Florida is a "no fault state," arguing that his wife's claims that the marriage ended because of his "extramarital affairs and other marital misconduct" are "immaterial and impertinent and should be stricken," the papers read.
In her July 7 divorce filing, which included allegations of her husband's infidelity, Cynthia Rodriguez sought to maintain her "high standard of living." In addition to alimony and child support, she asked to keep the couple's $12 million Coral Gables mansion, as well as "equitable distribution" of all assets acquired during the marriage.
However, baseball's highest-paid player responded in his court papers by saying, "Husband denies any duty to support wife beyond those obligations specifically set out in the parties' prenuptial agreement."
What those terms are weren't immediately known, but A-Rod says that if he has to go to court and fight for the prenup to be enforced, he is entitled to recover any "reasonable attorney's fees and costs."
Rodriguez does admit in the filing that his wife is a "loving and nurturing mother." He even says it's possible for the pair, who married in 2002, to work out a time-sharing custody schedule for their two children, Natasha, 3, and Ella, three months, without the court's intervention.
"Cynthia and Alex are both very good people and they both have the best interests of their kids at heart," the slugger's attorney, Alan Kluger, told the Daily News. "This is a tough time for both of them and they prefer to handle this matter as privately and amicably as possible."
