Attorneys for the 17-year-old Hogan, whose real name is Nick Bollea, made the request in a court filing Monday.

Nick Hogan pleaded no contest to reckless driving with serious bodily harm last month, stemming from an Aug. 26 Florida car crash that seriously injured his passenger and friend, John Graziano.

He is currently serving an eight-month jail sentence in a Florida county jail, where he currently spends 16 to 17 hours a day in a maximum security cell.

Hogan’s attorneys filed papers seeking a transfer to monitored home confinement or the minimum-security area.

“Understandably, this situation creates an unbearable anxiety for a minor in solitary confinement,” the court papers said, adding that Hogan’s confinement “substantially amounts to cruel and unusual punishment for a juvenile and is not warranted for a non-violent first offender serving a probation sentence.”

Last week, the family of John Graziano expressed outrage over recently leaked conversations between Hulk and Linda Hogan and their son while behind bars.

In one conversation, Linda Hogan (real name Linda Bollea) is heard being critical of the victim’s mom, Debra Graziano, saying, “She’s not sad. She’s just acting angry like she just wants the money. John never meant anything to her or Ed (John’s father). It’s just sad because I really appreciated you kids, and I just miss John. I miss you, too. She’s not suffering. I am. I have the loss.”

The victim’s family reacted with outrage in a statement, with mother Debra Graziano saying, “They don’t care a bit about my son, all they are doing is planning a party.”

On Monday, Nick Hogan’s attorneys sued the Pinellas County sheriff, accusing jail officials of violating his privacy. The lawsuit claims the recordings were released improperly and that the jailers allowed a news crew to film the family.
