So far, the holiday season has been anything but merry for Halle Berry.
In the wake of the Thanksgiving day throw-down between her fiancé Olivier Martinez and ex-boyfriend Gabriel Aubry, Berry is still picking up the pieces of her family. Aubry was arrested on suspicion of battery after the French model came to blows with Martinez in the driveway of Berry’s Hollywood home on Nov. 22. The blowout brawl landed both parties in the hospital — where Aubry was treated for a broken rib and facial injuries, and Martinez for neck and hand contusions.
In the aftermath, Berry was award an emergency restraining order — which expires Nov. 29 — against Aubry, requiring him to stay 100 years away from the actress, their 4-year-old daughter Nahla and Martinez. Aubry then obtained a restraining order of his own, banning Martinez from harassing, intimidating or contacting him.
Though Aubry is due in court on Dec. 13 for his misdemeanor battery charge, law enforcement officials suspect he will not be prosecuted because the scuffle was mutual combat. The Los Angeles city attorney is expected to review the fight next week to determine whether Aubry should face criminal charges, according to the L.A. Times.
Since splitting in 2010, Berry and Aubry have shared custody of their daughter, Nahla. But any cordiality between the exes turned to ashes after Berry sought a court’s permission to move Nahla to Paris, France, where the actress would live with her France native fiancé.
