Eliot Spitzer, filed a lawsuit Monday against Girls Gone Wild founder Joe Francis, according to The Associated Press.

Dupré’s suit, which seeks more than $10 million in damages, alleges she never gave permission for Girls Gone Wild to use her name and likeness to advertise videos. The claim was filed in a Miami federal court.

Dupré was captured on video during a trip to Miami Beach in 2003. She argues that she was only 17 at the time and not of age to sign a contract, AP says. Francis told UsMagazine.com that he is “amazed” by Dupré’s allegations.

“It is incomprehensible that Ms. Dupré could claim she did not give her consent to be filmed by Girls Gone Wild, when in fact we have videotape of her giving consent, while showing her identification,” Francis told Us in a statement.

In March, Dupré, 22, found herself in the center of a scandal surrounding Spitzer, who was forced to resign his post after his association with a prostitution ring became public. Dupré was later identified as a prostitute by the name of “Kristen” who was hired by Spitzer on several occasions.
