HOLLYWOOD, Calif. — It turns out there are a few more curious eyes peaking at Eric Dane and Rebecca Gayheart’s nude tape.
On Thursday, the Los Angeles Police Department confirmed they are investigating the steamy video, in which the married couple lounges around naked with former beauty queen Kari Ann Peniche.
Authorities received the DVD at the end of July from an unnamed source, who claimed it “contained images that could link celebrities engaging in illegal activity.”
The trio appears intoxicated in the video, which includes each of them sharing their porn names as they splash together in a jacuzzi and lay nude together in bed.
At one point, the 38-year-old Gayheart says she needs to lie down because she’s “so high.”
The police said they were in the process of reviewing the sex tape when it was leaked onto the Web earlier this week. They noted that is also contained “archived articles and photographs of porn stars and formally convicted madams, which could readily be found over the internet.”
“No determination has been made as to whether or not the DVD contained any information that could be used for a criminal investigation,” officials said.
On Monday, an attorney for the actors issued a statement threatening legal action against anyone using the video for commercial purposes.
“This is simply a private, consensual moment involving a married couple, shot several years ago, which was never intended to be seen by the public,” said attorney Marty Singer. “Although the participants are nude, the tape is not a ‘sex tape.’ It is a private tape made for only my clients’ personal use, and nobody has the right to exploit it. If anyone exploits the tape, they will be violating my clients’ rights and will be exposed to significant liability.”
