LOS ANGELES – A sex tape featuring Tupac Shakur has been discovered.
The five minutes of footage allegedly shows the rapper - who died from injuries sustained in a drive-by shooting in 1996 - receiving oral sex from an unidentified woman while he sings and dances along to his own music.
LOS ANGELES — Eric Dane and Rebecca Gayheart have filed a lawsuit against Gawker.com, accusing the Web site of refusing to comply with a cease and desist request related to their now infamous non-sex tape.
In the suit, which was filed Thursday in Los Angeles County Superior Court, the couple accuses Gawker of "maliciously" posting the video, which shows the couple romping around naked inside their home with former beauty queen Kari Ann Peniche.
Peniche has claimed that the tape surfaced after her "Celebrity Rehab" roommate, country singer Mindy McCready, stole her computer hard drive and leaked the footage.
Dane and Gayheart are seeking more than $1 million in damages, in addition to ensuring that the video is pulled from various Web sites that have since obtained the footage.
The couple's attorney, Marty Singer, threatened legal action soon after the video first surfaced in August.
"This is simply a private, consensual moment involving a married couple, shot several years ago, which was never intended to be seen by the public," Singer said in a statement at the time. "Although the participants are nude, the tape is not a 'sex tape.' It is a private tape made for only my clients' personal use, and nobody has the right to exploit it. If anyone exploits the tape, they will be violating my clients' rights and will be exposed to significant liability."
Gawker publisher Nick Denton responded to the lawsuit by posting a message Wednesday on his Twitter page.
"To quote the great Marty Singer — Eric Dane's lawyer — if you don't want a sex tape on the internet, 'don't make one!' " he wrote.

LOUISVILLE, Ky. — Rick Pitino may be facing the biggest defensive challenge of his storied career.
The legendary basketball coach, who has been married for 33 years, is at the center of an affair scandal after he allegedly admitted to having sex with the woman accused of trying to extort money from him.
According to the Associated Press, the 56-year-old Pitino admitted to police that he had sex with Karen Cunagin Sypher after she approached him at the Louisville restaurant Porcini in August 2003.
Cunagin Sypher, 49, is said to have approached Pitino first, asking if he would call her sons. Some time later, Pitino and Cunagin Sypher had sex at a table after the restaurant closed and the owner left the keys to his establishment with the Louisville coach.
Pitino's former assistant, Vinnie Tatum, was also at the restaurant when the pair hooked up, telling the FBI that he heard "the sounds of two people that seemed to be enjoying themselves during a sexual encounter," AP said.
Pitino told police that he got a phone call from Cunagin Sypher about two weeks later, in which she told him that she was pregnant and that she was convinced that he was the father. He reportedly suggested that they meet up at the home of his equipment manager, Tim Sypher, who in a bizarre twist later married Pitino's alleged mistress.
The coach is said to have given Cunagin Sypher $3,000 to cover the cost of an abortion. Pitino's attorney, Steve Pence, claims the payment was for "insurance, not an abortion."
"The way this has been reported in the media is not accurate," Pence told AP. "The coach has not done anything illegal."
The details behind the sex scandal were revealed after Pitino claimed in April that Cunagin Sypher was trying to extort $10 million from him. She has since pleaded not guilty to federal charges of lying to the FBI.
After being charged, Cunagin Sypher claimed that Pitino had raped her twice, the first time being at the restaurant when they first met.
When asked about the latest developments, University of Louisville president James Ramsey told AP that some of the new details were "surprising."
"Several months ago, Coach Pitino informed me about the alleged extortion attempt. I've now been informed that there may be other details which, if true, I find surprising," Ramsey said in a statement.
Whether the sex scandal leads to Pitino taking a leave of absence remains to be seen, but his attorney told ESPN that is highly unlikely.
"He doesn't deserve to be punished for something he hasn't done," said Pence. "I can see no reason why he would take a leave of absence when he was being extorted. He has done nothing illegal."
Pitino and his wife Joanne married in 1976 and have five living children. Their son Daniel died in 1987 from congenital heart failure at the age of six months.
The Sypher's are currently going through a divorce.
LOS ANGELES — Ashley Greene is the latest young star to fall victim to a nude photo scandal.
On Monday, nude pics of the 22-year-old actress began surfacing on the Web, resulting in a stiff warning from the "Twilight" star's attorney.
"The photos in question, which appear to be of our client, are illegal and are being unlawfully displayed," said Greene's lawyer in a statement. "Our client intends to take legal action."
The scandal comes less than a week after another round of naked pictures surfaced of Vanessa Hudgens. The "High School Musical" star previously copped to a nude photo scandal in September 2007, calling the matter "unfortunate."
Greene was on hand for Sunday night's Teen Choice Awards, where she surfed away with the Choice Fresh Face Female award.

HOLLYWOOD, Calif. — Tom Sizemore is facing more legal trouble after allegedly having a heated dispute with his fiancé.
LOS ANGELES — Vanessa Hudgens may take legal action against Web sites who publish a new round of nude pictures that have surfaced of the Disney star, sources tell TMZ.com.
New pictures of a woman baring a striking resemblance to the 20-year-old actress were leaked Wednesday, with several Web sites publishing the racy photos. The star's attorney tells TMZ that the pictures were taken when Hudgens was underage, which would constitute a federal crime if published.
Her attorney has since sent cease and desist letters to the publications, TMZ said.
Sources tell TMZ that Hudgens uploaded the naked pics to her computer and that she may have fallen victim to a hacker.
Hudgens previously copped to a nude photo scandal in September 2007, calling the matter "unfortunate."
"I want to apologize to my fans, whose support and trust means the world to me," she said in a statement after the risqué private pics of her surfaced. "I am embarrassed over this situation and regret having ever taken these photos."
Months after her naked pics hit the Web in 2007, Hudgens spoke about the experience in an interview with Seventeen.
"It was very traumatic, and I am extremely upset it happened," she said. "I hope all my fans can learn from my mistake and make smart decisions. But I wouldn't have been able to get through it if it wasn't for my family, friends and fans, who supported me all along the way."
Hudgens also said that much has changed since the Web went mainstream, although perhaps she didn't listen to her own advice.
"With the Internet these days, you don't have a personal life. Nothing is private: Everyone knows everything, and they can find out everything about you," she told the mag. You're not as safe as you think you are, and you have to be aware of the people you're around."

LOS ANGELES — Leighton Meester loves the fact that she's part of a hit show, but the "Gossip Girl" star would prefer to stay out of the tabloid limelight.
"I don't want most of what comes along with all of this," the 23-year-old actress confesses in the September issue of Harper's Bazaar.
One such tabloid rumor that Meester is still fuming about is the one about her so-called sex tape that surfaced in June. It was said that Meester shot the video with an ex-boyfriend when she was 18.
"[The tape] is not real," Meester insists, "so it makes me sort of sad. It's unfortunate that it got carried as far as it did."
While the sex tape chatter was upsetting, Meester says it proved to be a valuable lesson.
"I definitely understand the nature of people better now and that the mere allegation of something like that could be headline news," she tells the mag. "People think it's real because somebody says it is."
"By the way, [as for] me being 18 in those pictures, I don't believe I was," she adds.
Meester has developed some tough skin to go along with her sudden fame and she's become very protective of her inner circle.
"I'm doing everything I can to keep things separate," she explains. "I feel like my friends are in a cult because we're like, No outsiders! I've never been crazy. I'm a very good girl, to be honest. I don't do anything to hurt anybody. Honestly, all I ever do is work."
One such member of Meester's inner circle is her fellow co-star Ed Westwick, who admits to having developed a unique bond with the Texas native.
"The first thing I thought when I met Leighton was, F---ing hell, this girl's gorgeous," he says. "And she was incredibly sweet. Now we tell each other to f--- off whenever we want to."
HOLLYWOOD, Calif. — Roberto Alomar spoke out for the first time Wednesday after an ex-girlfriend filed a lawsuit against him, claiming he had unprotected sex with her for four years despite having AIDS.
"This is a very private, personal matter and I greatly appreciate all the support I have received in the past few days from my family, friends and colleagues in baseball," the former baseball star said in a statement to The Associated Press. "I am in very good health and I ask that you respect my privacy during this time."
